Our Franchise Dispute Resolution Team – representing franchisees

Our dedicated franchise dispute resolution team have over 35 years combined experience of handling disputes, representing franchisors, franchisees and action groups of franchisees. They are headed up by Russell Ford, assisted by Nicola King, Lynsey Smith and Alicia West. The 2015 Chambers Guide to the UK Legal Profession recently described Russell as; “… a fantastic litigator – right from the get-go he is thinking tactics and substance. We have worked with many franchisees wanting to extricate themselves from franchise agreements for various reasons.

Terminating a franchise agreement

This can include the franchisor failing to maintain the reputation of the brand, failing to support franchisees, reducing the number of staff and business development managers working in the field to help franchisees in their business, increasing demands for fees without improving the service and support to franchisees and, in some cases, trying to limit the franchisees’ ability to sell their own businesses.

Misrepresentation

A common complaint by franchisees is that they have been mis-sold the opportunity. we will advise you on potential claims, compensation prospect of success and risks.

Conflict Resolution

Conflict resolution is at the heart of what we do. Court proceedings are expensive and for individual franchisees can be unaffordable. We are able to offer, in some circumstances, conditional fee agreements or damages based agreements to help franchisees pursue their claims when there is inequality of arms. However, our focus is on an early resolution usually through a mediation or without prejudice meeting.
