Our dedicated franchise dispute resolution team have over 35 years combined experience of handling disputes, representing franchisors, franchisees and action groups of franchisees. They are headed up by Russell Ford, assisted by Nicola King, Lynsey Smith and Alicia West. There are many great franchise opportunities available to the hard-working entrepreneur looking to buy a franchise in the UK. However, for every great franchise business there are a few whose franchisees or groups of franchisees may find themselves searching the internet for advice on ‘breach of contract’ or similar. This is where we can help.

Franchise Litigation

Litigation is expensive. Court proceedings can be time consuming and cost many tens of thousands of pounds. Frequently action groups are formed because there is a groundswell of discontent within a network and franchisees elect to share the cost of legal advice by forming groups. We are able to offer many years of commercial, practical and legal experience of handling and advising such groups in order to negotiate settlement terms with the franchisor. This can sometimes mean an exit of franchisees from the franchise network or can involve compensation payments or re-negotiating contractual terms. An example: We assisted a network of franchisees of a high street brand in re-negotiating their contracts and reducing their fees. Another example was a £1m High Court claim for 70% of a network challenging a franchisor’s attempt to convert their local customers into national account clients, siphoning profits to the franchisor. Many franchisors have proposed the idea of franchisees forming their own associations. These associations are designed to represent the interests of franchisees and to provide input into the direction of the network business, marketing, winning national account work and generally promoting the business. These associations work with the franchisor rather than against them and we are retained by a number of franchisee associations in very high profile franchise networks to provide legal advice, particularly around re-negotiation of franchise agreements, pricing structures and amendments to operations manuals.
