Breach of Tenancy/Lease

Section 21

The Property Dispute Team are specialists in seeking possession of assured shorthold tenancies by way of Section 21 Housing Act 1988. The team regularly advises Registered Providers, private landlords and letting agencies and have an outstanding record of success in obtaining possession by way of the accelerated Court procedure.

In addition to seeking possession by way of Section 21, the team can offer general management advice in respect of changes in legislation, tenancy deposit schemes, gas safety, EPCs and HMOs.

The team understands the complexities of forfeiture and regularly assists landlord and tenants in dealing with forfeiture and relief from forfeiture including advising on Section 146 notices, waiver, determinations and Court and Tribunal proceedings.

Despite the reported difficulties in enforcement against residential long leaseholders the Property Dispute Team have successfully represented clients at Court and obtained possession by way of forfeiture.

Termination of Business Tenancies / Leases

The Property Dispute Team offers specialist advice to our business clients in relation to their statutory and/or contractual rights and obligations associated with their commercial sites and premises. The team understands the strict procedures and complexities of the Landlord and Tenant Act 1925 and other statutory procedures and is able to offer comprehensive and practical advice on a wide range of issues.

The team frequently provide advice on security of tenure, possession of commercial premises/sites and service of statutory notices.
