Brexit and Trade Marks: An Update

Insights Brand Protection

From 1 January 2021 all EU trade mark registrations will no longer cover the UK.
However, all EU trade marks that have been registered before 31 December 2020 or ‘IP Completion Day’, will be automatically converted by the UK Intellectual Property Office into their own fully independent UK trade mark holding the original EU trade mark filing date. There will be no additional fees to pay.

Amazon Brand Registry

Insights

Amazon’s Brand Registry helps brand owners protect their IP rights and creates “an accurate and trusted experience for customers”. The Registry ensures that the trade mark owners are the only sellers who can sell their products on Amazon.

UK Trade Mark Infringement

Insights

Once a trade mark is registered, the owner has the exclusive right to use the mark in the UK. This allows an owner to stop others from using their mark or a confusingly similar mark in relation to the goods and services that their mark was registered for.
